These Terms of Service ("Terms") govern your access to and use of the ImageGather website and related tools (collectively, the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Eligibility and the nature of the Service

ImageGather provides an online utility to help users identify and download image assets from web pages they choose to analyze. The Service is provided for general information and productivity purposes. It is not legal advice, and it is not a substitute for your own judgment about copyright, licensing, contracts, or computer misuse rules in your jurisdiction.

Acceptable use

You agree to use the Service only in lawful ways and only on content and systems you are authorized to access. Without limitation, you must not:

• Use the Service to violate any applicable law or regulation, or any third-party terms (including robots.txt or similar technical restrictions where they create a binding obligation you have agreed to).
• Attempt to scrape, overload, disrupt, or probe our infrastructure beyond normal personal or business use, including circumventing rate limits or security controls.
• Upload or request processing of URLs that distribute malware, illegal content, or content you know you are not entitled to copy.
• Misrepresent your identity or affiliation, or use the output of the Service to harass, defraud, or harm others.

We may suspend or throttle access when we reasonably believe these rules are being broken.

Intellectual property and third-party content

Images and other materials hosted on third-party websites belong to their respective owners. ImageGather does not claim ownership of third-party content. You are solely responsible for ensuring you have the rights, licenses, or permissions needed to download, store, modify, or redistribute any files you obtain through the Service. If you are unsure, consult the site owner or qualified counsel before copying or publishing material.

No warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT RESULTS WILL BE COMPLETE, ACCURATE, OR FREE OF ERRORS, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR SECURE.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL IMAGEGATHER, ITS OPERATORS, AFFILIATES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) FIFTY U.S. DOLLARS (US $50), IF YOU HAVE NOT PAID US ANYTHING.

Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the fullest extent permitted by law.

Indemnity

You agree to defend, indemnify, and hold harmless ImageGather and its operators from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party right, including intellectual property or privacy rights.

Service changes and availability

We may modify, suspend, or discontinue features, impose or adjust usage limits, or change how the Service works at any time, with or without notice, for operational, legal, or security reasons. We are not liable for any modification, suspension, or discontinuance.

Governing law and disputes

These Terms are governed by the laws applicable to the operator of the Service, without regard to conflict-of-law rules. Courts in a competent venue may hear disputes unless mandatory consumer protections in your country say otherwise. If a provision is found unenforceable, the remaining provisions remain in effect.
